If you're not going to discriminate on the basis of marital status,
then why do you ask that question? On a job application, there is only
so many ways you can act on the information. You can either choose not
to interview that individual or not hire him/her. Both of these
constitute illegal discrimination.

But that question will serve as evidence against your company in a case.
