Well, it's pointless to argue about the legality of a individual act
when the purpose of anti-discrimination laws is to defer a pattern of
behavior. It is not illegal to ask someone's marital status. Nor is it
illegal to not hire a married person. What is illegal is the systematic
exclusion of married people (or vice versa) from a given work place, to
which inquiry on an job application is an enabling mechanism.
