In the United States and Canada, at least, he is NOT ALLOWED to care about
it. He prohibited BY LAW from using your marital status in making a
decision whether or not to hire you. It is a violation of the Equal
Employment Opportunity guidelines.

Companies do not have laws. Countries have laws.

Once a person has been hired, the company is entitled to ask them for
certain personal information. Government statistics are one reason,
insurance purposes are another. That is covered by an entirely different
set of laws than the application process.
